I have run a live PSW agency in St. Thomas, Ontario for three years. I have been through every step of the startup process. I have made mistakes. I have learned what works.

This guide covers everything you need to know to start a PSW agency in Ontario in 2026. It is long—because this is a complex business. But if you read it carefully, you will have a clear roadmap for getting started.

You need to get all of this right from the start. If you do not, you will be playing catch-up later—and that is expensive.

Why This Matters Right Now in 2026

Several regulatory and market shifts make 2026 a unique time to start a PSW agency.

HSCPOA registration is the new reality. As of December 1, 2024, PSW qualifications were to align with registration pathways established by the HSCPOA Act . While registration is technically voluntary, under O.Reg 246/22, PSWs hired after January 1, 2026 can be required to have HSCPOA registration as part of their job qualifications . This means your agency will need to track HSCPOA status.

Ontario Health atHome prequalification is active. The service provider prequalification process identifies potential vendors eligible to provide publicly funded home care services . Once prequalified, service providers can bid on home care service procurements in Ontario . If you want government contracts, you need to be prequalified.

The Solution: A Step-by-Step Roadmap

Here is the complete roadmap for starting a PSW agency in Ontario. Follow these steps in order.

Phase 1: Business Setup

Step 1: Choose Your Business Structure

You need to decide on a legal structure for your business. Most PSW agencies incorporate as a corporation—either federally or provincially.

Incorporation options:

  • Federal incorporation (CBCA): You get name protection across Canada. You need to file annual returns. You can register in any province.

  • Provincial incorporation (OBCA): You incorporate in Ontario only. You get name protection in Ontario. You do not need to file federal annual returns.

For most PSW agencies, provincial incorporation is simpler and sufficient. A corporation protects your personal assets and gives you credibility with clients and government agencies.

Your registered office address—the address on your Articles where official documents are served—can be a Canada Post Unit/# format address or commercial mailbox; P.O. Boxes are not accepted .

Step 2: Register Your Business Name

If your business name is different from your personal name, you need to register it with Service Ontario. This gives you the legal right to operate under that name.

Step 3: Get Your CRA Business Number (BN)

You need a CRA Business Number to operate as a business in Canada. Your CRA Business Number is required for:

  • Corporate income tax (T2 returns)

  • GST/HST registration (if you are taxable or registering voluntarily)

  • Payroll deductions (if you have employees)

Your CRA Business Number and T2 mailing address can use the same commercial address as your registered office .

Step 4: Set Up a Business Bank Account

You need a dedicated business bank account. This separates your business finances from your personal finances. It makes accounting and tax filing much easier.

Step 5: Determine Your GST/HST Status

This is one of the most common mistakes PSW agency owners make.

Under the Excise Tax Act Schedule V, Part II, section 13, a home care service is exempt only where there is a public-funding nexus . This means one of three conditions must be met:

  1. The supplier is a government or municipality.

  2. A government, municipality, or organization administering a government program pays an amount toward the supply.

  3. The same individual is concurrently receiving a publicly funded home care service.

If none of these conditions apply—if you are a purely private-pay agency paid only by the client or family, with no government funding link—your services are generally taxable, not exempt .

What this means for your agency:

  • If you are purely private-pay, plan on your services being taxable.

  • You must register for GST/HST once you exceed the small-supplier threshold ($30,000 in taxable supplies over four consecutive calendar quarters).

  • If you have a mix of funded (exempt) and private-pay (taxable) clients, you need to track which is which and apply the correct tax treatment to each invoice .

Do not assume your services are exempt. Confirm your funding nexus before deciding not to register .

Phase 2: Legal and Regulatory Requirements

Step 6: Understand Your HR and Employment Obligations

If you hire PSWs as employees, you have significant obligations under Ontario employment law.

WSIB registration. If you hire employees, you need to register with the Workplace Safety and Insurance Board . WSIB provides coverage for workplace injuries. Registration duties depend on your payroll and industry classification.

OHSA compliance. Home care is a higher-risk OHSA environment despite not having the obvious hazards of a manufacturing plant . PSWs work alone in clients' homes—sometimes with clients who have cognitive impairments, dementia, or behaviors that present safety risks .

OHSA obligations by headcount:

  • Any employer: Written violence and harassment program; general duty to protect workers 

  • 6-19 employees: Health and Safety Representative (non-management, worker-selected) 

  • 20+ employees: Joint Health and Safety Committee (JHSC) with trained co-chairs; quarterly meetings 

  • 20+ employees (June 1, 2026): Automated External Defibrillator (AED) in the workplace 

  • 25+ employees: Disconnecting from Work Policy; Electronic Monitoring Policy if using GPS/scheduling app 

Pay transparency rules (effective 2026):

  • Salary range required in job postings (max $50,000 spread) 

  • No "Canadian experience required" in postings 

  • AI screening disclosure required if used 

  • 45-day candidate notification requirement 

  • Directors can be personally liable for violations up to $100,000 

Step 7: Understand Privacy and PHIPA Obligations

If your agency collects health-related information, care notes, diagnoses, medication details, or other sensitive client information, privacy controls must be built from day one .

No, HSCPOA registration is technically voluntary. However, under O.Reg 246/22, PSWs hired after January 1, 2026 can be required to have HSCPOA registration as part of their job qualifications .

Many employers are making it mandatory. If you cannot verify registration status, you will lose candidates to agencies that can.

HSCPOA registration pathways:

There are four pathways to registration :

  1. Pathway 1: Completion of Ontario PSW education on or after July 1, 2014 (no action required)

  2. Pathway 2: Completion of 600 hours of PSW work in the prior three years (must register by December 1, 2027)

  3. Pathway 3: Registered in another Canadian jurisdiction (BC, AB, NS)

  4. Pathway 4: Competency assessment (for experience outside Canada)

Important note for employers: Pathway #2 is the most common way current workers get certification. This process closes December 1, 2027 . PSWs with work experience require an employer to confirm their employment and skills. Employers are not obligated to do this .

Step 9: Understand the Worker Classification Decision

One of the most important decisions you will make is whether to hire PSWs as employees or engage them as independent contractors.

The risks of misclassification:

The CRA is actively enforcing worker classification rules in healthcare staffing. If you treat a PSW as an independent contractor when they should be an employee, you could be liable for back taxes, penalties, and interest.

The five-factor test:

The CRA uses a five-factor test to determine worker classification:

  1. Control over work

  2. Ownership of tools and equipment

  3. Opportunity for profit and risk of loss

  4. Integration into the business

  5. Written contracts

Practical considerations for PSW agencies:

  • If you control when, where, and how a PSW works, they are likely an employee.

  • If a PSW uses their own vehicle, phone, and equipment, and can choose their own hours, they may be an independent contractor.

  • Most PSWs who work exclusively for one agency, follow agency policies, and use agency tools should be classified as employees.

If you are unsure, consult an employment lawyer or HR specialist. Misclassification can be expensive.

Phase 3: Operational Systems

Step 10: Build a Connected System for Recruitment, Scheduling, and Payroll

2. Ontario Health atHome contracts: If you are prequalified, you can bid on publicly funded home care service procurement opportunities in Ontario . This is a stable revenue stream but requires prequalification.

3. Family-Managed Home Care (FMHC) Program: Families can manage their own care budgets and hire PSWs from a pre-vetted provider list . Being on this registry is critical for agencies serving FMHC families.

Step 12: Understand the Ontario Health atHome Prequalification Process

If you want government contracts, you need to be prequalified.

The prequalification process:

Ontario Health atHome, with support from Ontario Health, administers the service provider prequalification process as a key step in the procurement of safe, high-quality home care services across the province . Prequalification identifies potential vendors eligible to provide publicly funded home care services .

How to apply:

  1. Register on the Ontario Tenders Portal (OTP).

  2. Locate the "Prequalification for Home Care Service Provider Organizations" opportunity (Project Reference "2025 SPO Prequal").

  3. Complete the application, which requires information related to your ability to safely provide high-quality care, financial stability, and operational capacity.

  4. Submit through the Ontario Health SharePoint submission portal.

Prequalification does not guarantee a contract—it makes you eligible to bid . Prequalification status expires December 31, 2027 .

Phase 5: Ongoing Compliance

Step 13: Maintain Your Systems

Running a PSW agency is not "set it and forget it." You need to:

  • Track PSW credentials and HSCPOA registration.

  • Process payroll accurately with up-to-date CRA rates.

  • File GST/HST returns and claim input tax credits.

  • Maintain WSIB compliance.
